Drug Court eligibility is governed by a number of state and federal laws. In general, however, a participant is someone that has a chemical dependency problem and who has been arrested and charged with a lower level drug possession crime. Defendants who have a history of violence, have been arrested for drug trafficking, or have greater than three (3) felony level convictions within the preceding seven years are typically ineligible. The first inquiry is whether the person is charged with an eligible offense and the second inquiry is whether the person is appropriate for Drug Court. The Drug Court Team does, however, maintain discretion in recommending persons for participation. |
