Participants may enter the program on a voluntary basis and upon completion the criminal case may be dismissed or they may receive a reduced sentence. The process starts as soon as a potential participant is taken into custody. The prosecutor makes a preliminarty determination of eligibility and makes a charging determination. The matter is then referred to the Probation Department for additional eligibility evaluation. Once a person is considered eligible for the program, the court may order a chemical use assessment. During this time, the person is advised by their attorney as to the purpose of Drug court and the attorney is given an opportunity to review the complaint and police reports. If the person wishes to enter into program, he or she is given a date and time to make their first appearance in Drug Court.
Drug Court consists of three phases and a graduation. When competencies are achieved for a particular phase, the defendant may apply for a phase advancement. Following graduation, at the discretion of the Drug Court Team, a person may be placed on formal/informal probation for a period of time to be determined.
Phase I: Obtain a chemical use assessment and follow the recommendations; Minimum of two UA/PBT tests each week; Minimum of two meetings per week with probation staff; Drug Court review hearings at least 3 times a month; Maintain 3 months of sanction-less participation.
Phase II: Minimum of twice weekly UA/PBT testing; Minimum of twice monthly meetings with probation staff; Drug Court Review Hearings at least 2 times a month; Continued treatment; Education/Employment plans; Maintain 3 months sanction-less participation.
Phase III: Minimum of one test weekly; Minimum twice monthly meeting with probation; Minimum of 1 Drug Court review hearing per month; Maintain 6 months sanction-less participation; Education/Employment plans; Community Service Project.
Graduation 12 months chemically free.
