2010 Information
Filing for office is the process by which a candidate's name is placed on the ballot. These requirements vary depending on several factors including: 1) the office sought; 2) whether or not it is a partisan office or non-partisan office; and 3) whether the candidate is running as a member of a Major Political Party, a Minor Political Party, a member of some other political party, or as an independent.
Filing Period:
The filing period for federal, state and county offices to be elected in the November 2, 2010, State General Election:
o OPENS at 8:00 a.m. on May 18, 2010
o CLOSES at 5:00 p.m. on June 1, 2010 (Minnesota Statute 204B.09)
Please be reminded that county offices are closed on Monday, May 31, 2010, in observance of Memorial Day.
Filing dates for cities, townships, school districts and the hospital district offices vary. Please contact the appropriate election official for additional filing information and requirements.

Filing Location:
Candidates for federal offices must file with the Minnesota Secretary of State (Minnesota Laws 2008, Chapter 244).
Candidates for state and judicial offices may file with either the Minnesota Secretary of State or with the County Auditor of the county in which they reside (Minnesota Laws 2008, Chapter 244).
Candidates for city and township offices must file with their city or town's clerk (Minnesota Statute 205.13).
Candidates for school district offices must file with the school district clerk (Minnesota Statute 205A.06).
Candidates for the hospital district offices must file with the city or township clerk of residence (Minnesota Statute 447.32, subd. 4).
Withdrawal:
Affidavits of withdrawal are due with 48 hours of the close of filing and must be submitted to the filing officer where the candidate filed for office.
Affidavits of withdrawal from candidates for federal, state and county offices may be submitted to the filing officer by 5:00 p.m. on Thursday, June 3, 2010.
The withdrawal dates for affidavits of candidacy for city, township, school district and the hospital district offices vary based upon the filing period dates (Minnesota Statutes 204B.11; 205.13; 205A.06).
FILING FEES ARE NOT REFUNDABLE (Minnesota Statute 204B.11).
